Terms of Service

These Terms of Service (“Terms”) govern your access to and use of TwinCrew (“TwinCrew,” “we,” “us”), available at twincrewlabs.com (the “Service”). By creating an account or using the Service, you agree to these Terms. If you are using the Service on behalf of an organization, you agree on its behalf and represent that you are authorized to do so.

The Service

TwinCrew generates AI customer personas from data you connect and provides an AI team that produces user stories, campaigns, briefs, and research using those personas. Features, limits, and plans may change as the Service evolves.

Accounts and eligibility

You must be at least 16 years old and provide accurate account information. You are responsible for activity under your account and for keeping your credentials secure. Notify us promptly of any unauthorized use.

Plans, billing, and free tier

We offer a free tier with usage limits and may offer paid plans. Paid subscriptions are billed in advance through our payment processor (Stripe) and renew automatically until cancelled. Fees are non-refundable except where required by law. We may change pricing with reasonable notice.

Your data and connected integrations

You retain ownership of the data you connect and the content you create (“Your Data”). You represent that you have the rights and permissions necessary to connect each data source and to let us process that data. You grant us a limited license to host, process, and use Your Data solely to provide and improve the Service for you. Your use of any third-party integration is also subject to that provider’s own terms.

AI-generated output

Personas, briefs, chat responses, and research produced by the Service are generated by AI and may be inaccurate, incomplete, or unsuitable for a particular purpose. They are not professional, legal, financial, or marketing advice. You are responsible for reviewing and validating output before relying on or acting on it.

Acceptable use

You agree not to:

• Use the Service unlawfully or to infringe others’ rights.
• Connect data you do not have the right to access or process.
• Attempt to reverse engineer, disrupt, overload, or gain unauthorized access to the Service.
• Resell or misrepresent the Service, or use it to build a competing product from our confidential information.
• Upload malicious code or violate the usage limits and safeguards of connected providers.

Intellectual property

The Service, including its software, design, and content (excluding Your Data), is owned by TwinCrew and protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable right to use the Service during your subscription. Output generated from Your Data belongs to you, subject to these Terms.

Third-party services

The Service integrates with third parties (such as Google, HubSpot, Salesforce, Shopify, Klaviyo, Stripe, and others). We are not responsible for third-party services, and your use of them is governed by their terms and privacy policies.

Disclaimers

The Service is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that output will be accurate.

Limitation of liability

To the maximum extent permitted by law, TwinCrew will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenues, or data. Our total liability for any claim arising out of or relating to the Service will not exceed the amount you paid us in the twelve months before the claim.

Indemnification

You agree to indemnify and hold TwinCrew harmless from claims, damages, and expenses arising from Your Data, your use of the Service, or your violation of these Terms or applicable law.

Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate access if you violate these Terms or to protect the Service. On termination, your right to use the Service ends and we will delete or return Your Data as described in our Privacy Policy.

Changes to these Terms

We may update these Terms from time to time. When we make material changes, we will update the “Last updated” date above and, where appropriate, notify you. Continued use of the Service after changes take effect constitutes acceptance.

Governing law

These Terms are governed by the laws applicable at TwinCrew’s principal place of business, without regard to conflict-of-laws rules. Disputes will be resolved in the courts of that jurisdiction.
